Terms of Service

These Terms of Service ("Terms") govern access to and use of the Wallapop platform and website (collectively, the "Service") provided by Wallapop SL By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms.

You must be at least 18 years old and authorized to bind your organization to these Terms. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

The Service is billed on a prepaid credit model. One credit costs €0.10 (or the equivalent amount in USD, GBP, or PLN based on the exchange rate applied at checkout). Credits are consumed as you use Features from your account.

The current payment method is bank transfer; card, PayPal, and Stripe options are announced as they become available. Credits are non-transferable and, except where required by law or under our Refund Policy, non-refundable.

You agree to use the Service in accordance with our Acceptable Use Policy. Violations may result in suspension or termination without refund of unused credits.

You retain all rights to the data and content you submit. You grant Wallapop a limited license to process that content solely to operate, secure, and support the Service. Wallapop retains all rights to the platform, models, and derived aggregate insights that do not identify you or your organization.

Each party will protect the other's confidential information using at least the same care it uses to protect its own confidential information of similar sensitivity, and in any case a reasonable standard of care.

We warrant that the Service will materially conform to its documentation. EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

To the maximum extent permitted by law, Wallapop's aggregate liability arising out of or related to the Service will not exceed the amount paid to us in the twelve months preceding the claim. Neither party will be liable for indirect, incidental, special, or consequential damages.

Either party may terminate for material breach with 30 days' notice if the breach is not cured. Upon termination, your access to the Service will end and any unused credits will be handled in accordance with our Refund Policy.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, unless applicable consumer law grants you additional venues.

We may revise these Terms from time to time. Material changes will be posted at this URL and communicated by email at least 30 days before they take effect.
